Criminal Domestic Violence of a High and Aggravated Nature involves the same elements as CDV with the additional requirement that the State must prove that a deadly weapon was used in the assault, serious bodily injury occurred, or that the threat used caused the alleged victim to reasonably fear serious bodily injury or death.
CDVHAN is a serious felony which can carry up to 10 years. A plea to or conviction for CDVHAN also carries a mandatory minimum of one full year in prison, which cannot be suspended and early release is not possible. Further, with a CDVHAN conviction on your record, you will lose your right to own a firearm.
