Domestic Violence of a High and Aggravated Nature involves the same elements as Domestic Violence with the additional requirement that the State must prove that the person charged with the crime caused “great bodily injury” and showed an “extreme indifference” to the value of human life. The law gives several different examples of extreme indifference, but the list in not exhaustive. The law provides several other ways that a person can be charged with this felony.
Domestic Violence of a High and Aggravated Nature is a serious felony which can carry up to twenty years in prison. A plea to or conviction will also count as a violent strike under South Carolina’s “Three Strikes Law.” Upon conviction for a third violence crime, the State can serve notice of intent to seek a LWOP (Life Without Possibility of Parole) sentence.
